Employment is Freely Chosen 自由选择的雇佣关系,1.1 There is no forced, bonded or involuntary prison labor. 不可使用强制劳动力、受关押劳动力和不情愿的犯人劳动力。 1.2 Workers are not required to lodge deposits or their identity papers with their employer and are free to leave their employer after reasona

3、ble notice 雇员不应被要求交纳抵押金或把他们的身份证件交给雇主,在给出合理的预先通知之后,雇员可以自由地离开其雇主。,Law Reference 参考法规: China Labor Law, Article 50 中国劳动法 第五十条 Employment contract Law of the Peoples Republic of China, Article 9 中华人民共和国劳动合同法 第九条,1. Freedom Of Association 新年,放假1天(1月1日); 2. Three-day holiday for Spring Festival (The New Years Eve of the lun

6、ar year, the New Years Day and second day of the lunar year);春节,放假3天(农历除夕、正月初一、初二); 3. One-day holiday for Tomb-sweeping Festival (The lunar Tomb-sweeping Day);清明节,放假1天(农历清明当日); 4. 8、iscrimination Is Practiced禁止歧视,7.1 There is no discrimination in hiring, compensation, access to training, promotion, termination or retirement based on race, caste, national origin, religion, age, disability, gender, marital status, sexual orientation, union membership or political affiliation. 7.1

10、tion stipulation in factory policy, procedure and rules 公司的政策,程序和守则不应含有歧视性的规定 No discrimination activities in daily operation 公司的日常运作不应有歧视行为 No age, gender, and region restriction in hiring 公司招供不应有年龄,性别,地域的限制 Equal pay for equal work 应同工同酬,男女平等 No discrimination in hiring, wage, promotion, dismissin

Regular Employment Is Provided 正规的雇佣关系,8.1 To every extent possible work performed must be on the basis of recognized employment relationship established through national law and practice. 8.1 在尽可能的程度上,所进行的工作必须以按国家法律和常规所建立的、被正式 承认的雇佣关系为基础。,8. Regular Employment Is

12、 Provided 正规的雇佣关系,8.2 Obligations to employees under labor or social security laws and regulations arising from the regular employment relationship shall not be avoided through the use of labor-only contracting, sub-contracting, or home working arrangements, or through apprenticeship schemes where t

13、here is no real intent to impart skills or provide regular employment, nor shall any such obligations be avoided through the excessive use of fixed-term contracts of employment. 8.2 对受劳工或社会保障法律和法规保护的、建立在正规雇佣关系之上的对雇员的优惠,不能通过 使用劳动合同、分包合同或者在家工作的安排,或者通过不想真正传授技 术或提供正规雇佣关系的学徒项目来取消,任何类似优惠待遇也不能通过过度使用 固定期限的雇

No Harsh Or Inhumane Treatment Is Allowed不允许以苛刻和不通情理的方式对待雇员,9.1 Physical abuse or discipline, the threat of physical abuse, sexual or other harassment and verbal abuse or other forms of intimidation be prohibited 9.1 禁止使用人身虐待或体罚、或以人身虐待相威胁、性骚扰或其他骚扰以及恶语或其 他形式的恐吓。,9.
