2、nttheretoshallnotbecoveredunderthispolicy:1.gold,silver,pearls,diamonds,preciousstonesandjades;2.antiques,articlesofvirtue,ancientcoins,ancientbooksandancientpaintings;3.worksofartorpostagestamps;4.advertisements,aerials,neon,piecesofsolarenergyapparatusetc.onbuildings;5putersystemrecordsoritsmaking

3、andcopyingcosts.undernocirc umstancesshallthefollowingarticlesrelevanttheretobecoveredhereunder:1.guns,ammunitionore*plosives;2.banknotes,securities,bills,documents,files,accountbooksordrawings;3.animals,plantsandagriculturalcrops;4.mobilephones,puters,removablephotographapparatusorotherpreciousarti

4、cles;5.vehicleslicensedforgeneraltransportuse.ii.scopeofcoverthecompanyshallindemnifytheinsuredinrespectofthephysicallossofordamagetotheinsuredpropertystatedinthescheduleduringtheperiodofinsurancedirectlyarisingfromthefollowingperils:1.fire;2.e*plosion;butnotincludinge*plosionofaboilerorotherpressur

5、ereliefdevices;3.lightning;4.hurr icane,typhoonandtornado;5.storm,tempestandflood;butnotincludinglossordamagecausedbychangeinnormalwaterlevelorinundationfromseawaterorwaterescapeorleakagefromthenormalconfinesofanynaturalwatercourse,lakeorreservoir,canalordamaswellaslossofordamagetotheinsuredproperty

6、causedbystorm,tempestorfloodwhilebeingstoredintheopenorcoveredbyorunderashedthatchedwithreeds,tarpaulins,straw,asphaltfelt,plasticornylonsheet;6.hailstorm;7.landslide,rockslide,avalanche;8.volcanice*plosion;9.subsidenceofground;butnotincludinglossordamageresultingfrompiledriving,groundworkore*cavati

7、on;10.crashingaircraftandpartsorarticlesfallingfromaircraftandotherflyingobjects;11.burstingofwate rtankorpipe;butnotincludingburstingofwatertankorpipeduetorust.iii.e*clusionsthiscompanyshallnotbeliablefor:1.lossofordamagetotheinsuredpropertyore*pensescausedbyintentionalactorgrossnegligenceoftheinsu

8、redorhisrepresentative;2.lossofordamagetotheinsuredpropertycausedande*pensesincurredbyearthquakeortsunami;3.depreciation,lossofmarket,lossofuseandotherconsequentiallossesofanydescription;4.lossofordamagetotheinsuredpropertyore*pensesincurredarisingfromwar,warlikeoperation,hostilities,armedconflicts,

9、terrorism,conspiracyinsurrection,coupdetat,strike,riot,andcivilcommotion;5.confiscation,requisition,destructionordamagebyanyactionor orderofanygovernmentdejureordefactoorbyanypublicauthorities;6.lossofordamagetoinsuredpropertydirectlyorindirectlycausedore*pensesincurredbynuclearfission,nuclearfusion

10、,nuclearweapon,nuclearmaterial,nuclearradiationandradioactivecontamination;7.lossordamagecausedande*pensesincurredbypollutionofanykindordescriptionwhatsoeversuchasatmosphere,landandwaterpollutionsbutthisdoesnotincludelossordamagecausedbypollutionarisingfromperilsspecifiedinarticleiithepolicy;8.thede

11、ductiblesstatedinthescheduletobebornebytheinsured;9.lossordamagearisingfromanyotherperilsnotlistedinarticleiiofthispolicy.iv.treatmentpanyshallatitsoption,indemnifytheinsuredinrespectoflossordamagefallingwithinthescopeofcove rofthepolicybyeither:1.1payingtheamountoftheactualvalueofthepropertylostord

12、amagedor;1.2payingthenecessarycostofrepairingorrestoringthedamagedpropertytoitsnearestconditionimmediatelyprecedingthedamageor;1.3repairingorrestoringthedamagedpropertytoaconditionneartootherpropertyoflikekindandquality.2.indemnityunderthispolicyshallbebaseduponthesoundmarketvalueofthepropertyprevai

13、lingatthetimeofloss.ifthesoundmarketvalueofthedamagedpropertyislowerthanthesuminsuredofsuchproperty,theclaimshallbesettledonitsmarketvalue;ifthesoundmarketvalueofthepropertyisine*cessofthesupanyshallonlybeliableforsuchproportionoftheclaimasthesuminsuredofthedamagedpropertybearstoitssoundmarketvalue.

14、iftheinsuredpropertyenumeratedinthesched uleismorethanoneitem,theprovisionofthisclauseshallapplytoeachthereof.3.ifaclaimforlossofordamagetotheinsureditemissettledonatotallossbasis,thesalvagevalueofsuchitemshallbedeductedfromtheipanymay,atitsoption,declinetheabandonmentofanydamagedpropertybytheinsure

15、d.4.intheeventoflossofordamagetoanyequipmentiteminsuredformingpartofappanyshallnotbeliableinrespectofeachofsuchitemlostordamagedformorethanitsproportionatepartofthesupletepairorset.5.intheeventofanylosspanyshallalsopaytheinsuredforthee*pensesreasonablyincurredfortakingnecessarymeasurestominimizeloss

16、ordamagetotheleaste*tent,butinnocaseshallsuche*pensesreferredheretoe*ceedthesuminsuredoftheinsuredproperty.6.uponsettlementofaclaim,anendorsementshalpanytoreducet hesuminsuredcorrespondingtothepropertylostordamagedbytheamountsosettledfromthedateofloss,andnopremiumshallberefundedfortheamountsoreduced

17、.ifreinstatementofthesuminsuredisrequiredbytheinsureduponsettlementoftheclaim,anadditionalpremiumforthereinstatedamountshallbechargedatanagreedrate,andbecalculatedonproratadailybasisfromthedateoflosstothee*piryoftheinsurance.7.thetimeofvalidityofaclaimunderthisinsuranceshallnote*ceedaperiodoftwoyear

18、countingfromthedateofloss.v.insuredsobligationsthefollowingobligationsshallbestrictlyfulfilledbytheinsuredandhisrepresentative:1.theinsuredandhisrepresentative,whenapplyingforinsuranceshallmaketrueanswersordescriptionstothequestionsintheproposalandquestion naireortoanyotherquestiopany.2.theinsuredan

19、dhisrepresentpanyinduecoursetheagreedpremiuminthemannerasprovidedinthescheduleandendorsements.3.duringtheperiodofthisinsurance,theinsuredshallathisowne*pensetakeallreasonableprecautions,includingpayingsufficientattentiontoandputtingintopracticethereasonablerecommendationsofthecompany,prudentlyselect

20、ingtheworkmenandemployeesandcomplyingwithallstatutoryregulationsandsafetyoperationprocedures.4.intheeventofanyoccurrencewhichgivesormightgiverisetoaclaimunderthispolicy,theinsuredorhisrepresentativeshall:4.1notifythecompanyimmediatelyandwithinseven(7)daysoranyfurtherperiodasmapanyinwriting,furnishaw

21、rittenreporttoindicatethecourse,probablereasonande*tentoflossordamage 4.2takeallnecessarymeasurestoavoidaggravationofthelossordamageandminimizeittotheleaste*tent;4.3preservethespotaffectedanddefectivepartsbeforeaninspectioniscarriedoutbyarepresentativeorsurvpany;4.4furnishallsuchinformationanddocume

22、ntaryevidenceasthecompanymayrequireforsupportingtheclaim.vi.generalconditions1.policyeffectthedueobservanceandfulfilmentofthetermsandconditionsofthispolicyinsofarastheyrelatetoanythingtobedoneorcompliedwithbytheinsuredshallbeaconditionprecedenttoanyliabilityofthecompanyunderthispolicy.2.policyvoidan

23、cethispolicyshallbevoidableintheeventofmisrepresentation,m sdescriptionornon-disclosuremadebytheinsuredorhisrepresentativeinanymaterialparticularinrespectofthisinsurance.3.policyterminationunlessitscontinuancepanyinwriting,thispolicyshallbeautomaticallyterminatedif:3.1theinsurableinterestoftheinsure

24、dislost;3.2theriskoflossordamageisincreased.afterterminationofthepolicy,thepremiumshallberefundedtotheinsuredcalculatedonproratadailybasisfortheperiodfromthedateofterminationtothedateofe*piry.4.policycancellationthispolicymaybecanceledatanytimeattherequestoftheinsuredinwritingorattheoptionofthecompa

25、nybygivingafifteen(15)dayspriornoticetotheinsured.intheformercasethecompanyshallretainapremiumcalculatedonshorttermratebasisforthetimethepolicyhasbeeninforcewhileinthelattercasesuchpremiumshallbecalculatedonproratadailybasis.5.forf eitofbenefitiftheclaimisinanyrespectfraudulent,orifanyfraudulentmean

26、sordevicesareusedbytheinsuredorhisrepresentativetoobtainanybenefitunderthispolicyorifanylossordamageisoccasionedbytheintentionalactorintheconnivanceoftheinsuredorhisrepresentative,theninanyofthesecases,alltherightsandbenefitsoftheinsuredunderthispolicyshallbeforfeited,andallconsequentlossesarisingth

27、erefromincludingtheamountofclpanyshallbeindemnifiedbytheinsured.6.reasonableinspectiontherepresentativeofthecompanyshallatanysuitabletimebeentitledtoattendthesiteandinspectore*aminetheriske*plosureofthepropertyinsured.forthispurpose,theinsuredshallprovidefullassistanceandalldetailsandinformationpany

28、asmaybenecessaryfor theassessmentoftherisk.theabovementionedinspectionore*aminationshallinnocircumstancesbeheldasanyadmissiontothpany.7.doubleinsuranceshouldanyloss,damage,e*pensesorliabilityrecoverableunderthepolicybealsocoveredbyanyothepanyshallonlybeliabletopayorcontributehisproportionoftheclaimi

29、rrespectiveastowhethertheotherinsuranceisarrangedbytheinsuredorothersonhisbehalf,orwhetheranyindemnificationisobtainableundersuchotherinsurance.8.subrogationwhereathirdpartyshallbeheldresponsibleforthelossordamagecoveredunderthispolicy,theinsuredshall,whetherbeingindpanyornot,takeallnecessarymeasure

30、stoenforceorreservetherightofrecoveryagainstsuchthirdparty,anduponbeingindpany,subrogatetot hecompanyalltherightofrecovery,transferallnecessarydocumentstoandassistthecompanyinpursuingrecoveryfromtheresponsibleparty.9.disputealldisputesunderthisinsurancearisingbetweenthpanyshallbesettledthroughfriend

31、lynegotiations.wherethetwopartiesfailtoreachanagreementafternegotiations,suchdisputeshallbesubmittedtoarbitrationortocourtforlegalactions.unlessotherwiseagreed,sucharbitrationorlegalactionshallbecarriedoutintheplacewherethedefendantisdomiciled.vii.specialprovisionsthefollowingprovisionsshallbeapplie

32、dtoallpartsofthispolicyandshalloverridetheothertermsandconditionsofthispolicyifanyconflictarises.propertyinsurancepolicyp olicyno.:whereastheinsurednamedinthescheduleheretohasmadetothe_insurancecompany(hereipany)awrittenproposalwhichtogetherwithanyotherstatementsmadebytheinsuredforthepurposeofthispo
