1、居间效劳合同英文【篇一:房屋买卖居间合同(中英文版)_secret】 房屋买卖居间合同 brokerage contract of real property purchase 甲 方卖方: party a (seller): 乙 方买方: party b (buyer): 丙 方居间方: party c (agent): 信用的原那么,共同委托丙方代理并见证甲乙双方之间的买卖行为,经甲、乙、丙三方协商一 致,共同订立本合同,以兹各方共同遵守。 pursuant to relevant laws and regulations of the peoples republic of china

3、 hereby agree to enter into this agreement and abide by it jointly. 第一条 房产成交sales purchase of the property 甲方自愿将自有的房屋产权有偿转让给乙方。该房产符合北京市建设管理委员会制定的房屋 上市标准,甲方出售该房屋时亦同时将该房屋已分摊的土地使用面积和土地使用期限转让给 乙方。房屋具体情况如下: party a agrees to sell the property to party b. the property is qualified for sale in the market i

7、 limited to the title, decoration and relevant information; party b has fully understood the facts and agrees to buy the property voluntarily. 6、房屋共有人及共有人意见:co-owners of the property and intention for the sale 房屋共有人:指对房屋共同享有所有权的两个或两个以上自然人、法人或其他组织的共有 人。 property together. 第二条 成交价格及付款方式sales price and

13、emed that party b has performed its payment obligation of deposit and the sales price. 2、银行贷款mortgage 1乙方应在签订本合同当日,预先支付总房款的 %,作为保证双方履行合同的定金; 2乙方应在签订本合同 日内,另行支付 款,一并作为首付款首付款金额按照贷款银行的贷款条件不得低于房屋总价款的 %。 within _ days after signing of this agreement, party b shall make up the rest part of the down paymen

17、甲方给付定金和首付房款的义务。 party a and party b hereby agree that, for the afore-said method (b), once the escrow fund is deposited in the escrow account of century21 beijing region, it is deemed that party b has performed its payment obligation of deposit and the down payment. 乙方采用银行贷款的方式支付剩余房款,由21世纪不动产北京区域分部提

18、供统一的金融按 揭效劳,乙方须与21世纪不动产北京区域分部另行订立贷款委托协议。 if party b makes the remaining payment with bank mortgage, party b shall sign a separate entrusted payment authorization with century 21 beijing region for its mortgage services. 1 经办理贷款的银行审批,乙方符合贷款条件的,贷款银行依据乙方签署的?委托付款授 权书?将款项一次性划至甲方在同行开设的专用结算帐户。 if party b s

19、atisfies the criteria of getting the mortgage loan through the examination of the lending 2 方式解决: in case party b does not satisfy the criteria of getting the loan through the examination of the lending bank, party b will choose _of the following methods as the solution: a. 自银行做出不予批贷的决定起日内,乙方自行筹集剩余房

20、款,按照现金支付的形 式支付给甲方,乙方承当在此期间发生的各项费用; within _ days after the bank decides not to provide the loan, party b shall raise the remaining payment by himself and pay in cash to party a. party b shall bear all the expenses occurred during this period; b.终止本协议的履行,由甲乙双方返还相应款项,期间发生的各项费用由乙方承当。 terminate this agr

21、eement, and party a and party b shall refund the money which have been paid to each other. party b shall bear all the expenses occurred during this period. 三、关于税费相关规定 taxes and fees 1、本合同履行期间内,甲、乙双方自行按国家及地方相关规定自行缴纳各项税、费,丙方 协助甲乙双方进行相关税费确实认及计算工作。税费分担经甲乙双方协商,决定按照如下方 式进行分担: a. party a and party b shall

22、pay all the taxes and fees respectively in accordance with relevant regulations of the state and local governments. party c shall assist party a and party b to calculate relevant taxes and fees. through negotiation, party a and party b agree to bear the taxes and fees as follows: 双方对前述税费未约定、约定不明或遇政策

23、调整的,双方应在权属过户之日前 日内协商 并达成一致,否那么,按国家相关法律规定缴纳; for any taxes or fees unspecified, unclear, or changed with the policy, party a and party b shall reach a consensusdays before the title transfer, or party a and party b shall make the payment in accordance with the government regulation. 在上述房屋交付前未支付的物业管理费

24、、水、电、燃气、通信费等其他费用,由甲方承当, 房屋交付之后发生的前述费用,由乙方承当; fees including but not limited to property management fee, utility fees for water, electricity, gas, telephone and others before the handover of the property is concluded shall be born by party a. and the fees after shall be born by party b. 2、上述税费可在丙方向应付

25、费方预收后代为缴纳,相关部门所开具的完税凭证、行政事业 性收据、工本费发票等单据,待代理事项完成后,由丙方交付给付费的一方。 party a and party b may entrust party c to pay the aforesaid taxes and fees and party c shall transfer the payment proof, receipts and invoices issued by relevant government to the parties that make the payment. 第三条 居间报酬的金额及支付方式commissio

30、by party _to party c upon signing of this agreement (or, party a pay rmb and party b pay rmb to party c). 第五条 房屋交付handover of the property【篇二:居间效劳合同】 贷款居间效劳合同 甲方: 身份证号: 乙方: 根据我国?合同法?民法通那么?等法律规定双方代表经友好磋商后,一致同意订立本合同书。 一、 甲方委托乙方向银行以及其他贷款机构申请借款具体借贷金额由银行以及其他信贷机构评估审批后确定,甲方不得以额度大小为理由拒贷,拒贷产生的费用由甲方承当。 二、甲方职责

31、: 1、 提供借贷所需的真实性资料。 2、 积极配合办理相关手续。 3、 维护乙方权益。 三、 乙方职责: 1、 充分发挥资源优势,认真负责加速办理所有借款手续,在金融机构审批后,借款显示金额并成功提现即视为贷款成功。 2、 全面协调甲方与金融机构的关系。 3、 维护甲方权益。 四、居间效劳费:甲方须在银行以及其他贷款机构借款显示金额并成功提现后,一次性向乙方支付贷款总额的% 为居间效劳费。 五、 违约责任: 1、 乙方在本合同生效后如擅自撤销委托那么视作违约。 2、 银行以及其他贷款机构的贷款到达甲方银行账号当日,甲方保证支付居间效劳费到乙方指定的账号,每延误一天甲方按申请贷款总额 千分之五

32、 向乙方支付滞纳金。 3、如因政策调整及甲方贷款条件问题造成金融机构无法放贷的,甲乙双方对此均不承当违约责任。 六、 其它: 1、 本合同甲乙双方双方签字后即生效,在履约完毕后自行终止; 2、 本合同一式二份,甲乙双方各执一份,具有同等法律效力; 3、 本合同未尽事宜甲乙双方可协商解决; 甲方签字: 乙方签字: 日期: 日期:【篇三:居间效劳合同】 居间效劳合同 甲方:xxxx 乙方:xxxx 经双方协商一致,依据老实守信和公平公正原那么,订立居间效劳合同如下,以资双方共同遵守。 一、居间事项: 甲方现面向国内各地客户开展投融资效劳事项,并获知乙方能够提供内地需求资金客户信息并能够帮助甲方完成

33、融资效劳工作。现甲方委托乙方寻找介绍资金需求方,协助甲方帮助资金需求方完成融资效劳。乙方接受该居间委托,并严格履行,已达成双方目的。 二、居间人权利与义务: 1、乙方在接受委托时,可向第三方说明其为甲方的居间人,并可以向第三方介绍甲方融资效劳工程的相关情况。 2、乙方应认真完成甲方所委托居间事项,积极为甲方寻找时机,并为甲方及相关相对人签订协议提供联络、协助及撮合等效劳。 3、乙方在代理甲方所托事项过程中,因甲方过错造成其损失时,乙方有权要求甲方赔偿其损失。 4、乙方对甲方所做融资效劳款项不承当任何的担保责任。甲乙双方的关系仅为居间关系,不适用其他劳务关系相关约定或规定。 三、居间报酬 1、假

34、设乙方促成由借入资金意向的第三方与甲方签署相关投融资协议,并实际支付予第三方时,甲方按照融资额度的xx%向乙方支付居间报酬,该报酬在甲方或甲方所寻找的其他投融资主体向相对人支付款项前予以支付。2、居间报酬按照融资资金支付分批以现金方式支付,为税后净收益。 四、违约责任 本合同任何一方违反本协议之约定给对方造成损失的,都应赔偿因此而给对方造成的一切损失,并按照本居间效劳合同所确定的报酬数额的一倍承当违约责任。 五、争议的处理 本合同在履行过程中如发生争议,由争议双方友好协商解决,如协商不成的,任何一方都可提起诉讼。 六、其他约定事项 1、本协议中所知投融资事项及款项,甲方有权直接出资或另行居间介绍其他主体介入出资,无论是由甲方直接出资或由甲方再行居间介绍其他主体介入该事项,只要乙方所介绍之客户获得相对额度的资金,皆视为甲方与乙方按照本协议所约定的居间报酬结算依据。 2、本协议未尽事宜,双方可另行签订补充协议,补充协议与本协议具有同等法律效力。 3、甲方应对所操作融资效劳款项、操作程序的正当性及合法性承当责任。 4、本协议一式两份份,双方各执一份,签字盖章后生效。 甲方: 乙方: 代表: 代表: 签订日期:
