3、stry of Agriculture and Rural Affairs of the People's Republic of China (No. 4 [2021]) (2021年第4号) 《农业行政处罚程序规定》己经 2021年12月7日农业农村部第 16次常务会议审议通过,现予 公布,自2022年2月1日起施 行。农业农村部2020年1月14 日发布的《农业行政处罚程序规 定》同时废止。 部长唐仁健 The Provisions on the Procedure for Agricultural Administrative Penalties, as de

4、liberated and adopted at the 16th executive meeting of the Ministry of Agriculture and Rural Affairs on December 7, 2021, are hereby issued, and shall come into force on February 1, 2022, upon which the Provisions on the Procedure for Agricultural Administrative Penalties issued by the Ministry

5、 of Agriculture and Rural Affairs on January 14, 2020, shall be repealed. Tang Rcnjian, Minister December 21,2021 2021年12月21日 of not more than 200 yuan, in the case of a citizen, or not more than 3,000 yuan, in the case of a legal person or any other organization, or a warning, an administrati

6、ve penalty decision may be made on the spot, unless otherwise provided by law. Article 26 When making an administrative penalty decision on the spot, agricultural administrative enforcement officers shall abide by the following procedures: (1) Showing their identification to the party and produ

7、cing their administrative enforcement certificates. (2) Ascertaining the facts of violation of the party on the spot and collecting and keeping relevant evidence. (3) Before an administrative penalty decision is made, notifying the party of the content, facts, cause, and basis of the proposed

8、decision and the party's right to make statements and defenses. (4) Listening to and entering into the transcript of the party' statements and defenses. (5) Filling in an on-the-spot penalty decision in pre-determincd format, numbered, bearing the seal of the agricultural administrative penalty

9、 authority, signed or sealed by the enforcement officers, delivering it to the party on the spot, and stating the refusal of the party to sign for the administrative penalties therein, if any. The administrative penalty decision prescribed in the preceding paragraph shall contain the violation

10、by the party; the type and basis of the administrative penalty; the amount, time, and place of the fine; the channel and period for applying for administrative reconsideration and bringing administrative litigation; and the name of the administrative authority. 并有法定依据,对公民处以二百 元以下、对法人或者其他组织处 以

11、三千元以下罚款或者警告的行 政处罚的,可以当场作出行政处 罚决定。法律另有规定的,从其 规定。 第二十六条当场作出行政 处罚决定时,农业行政执法人员 应当遵守下列程序: (一)向当事人表明身份,出示 行政执法证件; (二)当场查清当事人的违法事 实,收集和保存相关证据; (三)在行政处罚决定作出前, 应当告知当事人拟作出决定的内 容及事实、理由、依据,并告知 当事人有权进行陈述和申辩; (四)听取当事人陈述、申辩, 并记入笔录; (五)填写预定格式、编有号 码、盖有农业行政处罚机关印章 的当场处罚决定书,由执法人员 签名或者盖章,当场交付当事 人;当事

12、人拒绝签收的,应当在 行政处罚决定书上注明。 前款规定的行政处罚决定书应当 载明当事人的违法行为,行政处 罚的种类和依据、罚款数额、时 间、地点,申请行政复议、提起 行政诉讼的途径和期限以及行政 机关名称。 第二十七条农业行政执法 Article 27 Agricultural administrative enforcement officers shall, within two days of making an on-the-spot penally decision, or of arriving on shore as in the case of handli

13、ng a case involving fishery administrative violation on the water, deliver the relevant materials of the case to their agricultural administrative penally authority for filing and safekeeping. Section 2 Ordinary Procedure Article 28 The ordinary procedure shall apply to the imposition of agric

14、ultural administrative penalties other than administrative penalty which may be administered on the spot according to the law. Article 29 An agricultural administrative penalty authority shall check clues to violations discovered within the ambit of its supervisory inspection, or through compla

15、ints, reports, transfers from other authorities, and assignments by superiors, within seven days of discovery of the clues or receipt of relevant materials, and the person in charge of the agricultural administrative penalty authority shall decide whether to open a case; and if the case is impo

16、ssible to open within the prescribed period due to special circumstances, an extension of seven working days may be granted with the approval of the person in charge of the agricultural administrative penalty authority, except as otherwise provided by the laws, regulations, and rules. Article 3

17、0 Where the following conditions are met, the agricultural administrative penalty authority shall open a case and fill in an approval form for filing an administrative penalty case: (1) There is any alleged violation of violating laws, regulations, and rules. 人员应当在作出当场处罚决定之 日起、在水上办理渔业行政违法 案件

18、的农业行政执法人员应当自 抵岸之日起二日内,将案件的有 关材料交至所属农业行政处罚机 关归档保存。 第二节普通程序 第二十八条实施农业行政 处罚,除依法可以当场作出的行 政处罚外,应当适用普通程序。 第二十九条农业行政处罚 机关对依据监督检查职责或者通 过投诉、举报、其他部门移送、 上级交办等途径发现的违法行为 线索,应当自发现线索或者收到 相关材料之日起七日内予以核 查,由农业行政处罚机关负责人 决定是否立案;因特殊情况不能 在规定期限内立案的,经农业行 政处罚机关负责人批准,可以延 长七日。法律、法规、规章另有 规定的除外。 第三十条 符合下列条件

19、 的,农业行政处罚机关应当予以 立案,并填写行政处罚立案审批 表: (一)有涉嫌违反法律、法规和 规章的行为; (二)依法应当或者可以给予行 政处罚; (2) An administrative penalties shall or may be imposed in accordance with the law. (3) The authority has jurisdiction. (4) There being a lapse in no excess of two years between the occurrence of the violation to

20、 its discovery, or between the end of the violation and its discovery, as in the case of an violation in successive and continuous state; and if the life and health of citizens are involved, and there are harmful consequences, the above periods shall be extended to five years, except as otherwi

21、se prescribed by law. Article 31 Where a case already opened is found not to meet the conditions for filing as specified in Article 30 of these Provisions based on the new circumstances, the agricultural administrative penalty authority shall cancel the filing. Article 32 For any agricultural v

22、iolation for which a case has been opened, an agricultural administrative penalty authority must comprehensively, objectively, and fairly conduct investigations, and collect relevant evidence; and may conduct inspections in accordance with laws and regulations, when necessary. There shall not

23、be less than two agricultural administrative enforcement officers present at the time of investigation, collection of evidence, or inspection. Parties or other relevant persons shall have the right to require the enforcement officers to present enforcement certificates. If the enforcement office

24、rs fail to do so, parties or relevant personnel shall have the right to refuse to accept investigation or inspection. Article 33 Agricultural administrative enforcement officers shall have the right to take the following measures in accordance with the law: (三)属于本机关管辖; (四)违法行为发生之日起至被 发现之日止未超

25、过二年,或者违 法行为有连续、继续状态,从违 法行为终了之日起至被发现之日 止未超过二年;涉及公民生命健 康安全且有危害后果的,上述期 限延长至五年。法律另有规定的 除外。 第三十一条对己经立案的 案件,根据新的情况发现不符合 本规定第三十条规定的立案条件 的,农业行政处罚机关应当撤销 立案。 第三十二条农业行政处罚 机关对立案的农业违法行为,必 须全面、客观、公正地调查,收 集有关证据;必要时,按照法 律、法规的规定,可以进行检 查。 农业行政执法人员在调查或者收 集证据、进行检查时,不得少于 两人。当事人或者有关人员有权 要求农业行政执法人员出示执

26、法 证件。执法人员不出示执法证件 的,当事人或者有关人员有权拒 绝接受调查或者检查。 第三十三条农业行政执法 人员有权依法采取下列措施: (一)查阅、复制书证和其他有 关材料; (1) Inspecting and copying documentary evidence and other relevant materials. (2) Questioning the party or any other entity or individual related to the case. (3) Requiring the party or any relevant

27、 person to provide relevant materials within a certain period. (4) Conducting investigation and collecting evidence by on-site examination, investigation, sampling, inspection, testing, authentication, assessment, determination, audio recording, taking photographs, video recording, and obtainin

28、g electronic data from on-site and surrounding surveillance equipment, and other means (5) Implementing sealing-up, seizure, and other administrative compulsion measures on any case-related site, facility or property according to the law. (6) Ordering the inspected entity or individual to disc

29、ontinue the violation and perform statutory obligations. (7) Measures otherwise set forth by the laws, regulations, and rules. Article 34 Evidence for agricultural administrative penalties includes documentary evidence, physical evidence, audiovisual information, electronic data, witness testi

30、mony, statements of the party, authentication opinions, transcripts of investigation, and on-site transcripts. Evidence may be used as the basis for agricultural administrative penalty authorities to determine the facts of cases only if authenticated. Evidential materials obtained or collected

31、 in accordance with the law before opening of a case may be used in evidence in the case. Illegally obtained evidence may not be used as a basis for determining the facts of a case. (二)询问当事人或者其他与案 件有关的单位和个人; (三)要求当事人或者有关人员 在一定的期限内提供有关材料; (四)采取现场检查、勘验、抽 样、检验、检测、鉴定、评估、 认定、录音、拍照、录像、调取 现场及周边监

32、控设备电子数据等 方式进行调查取证; (五)对涉案的场所、设施或者 财物依法实施查封、扣押等行政 强制措施; (六)责令被检查单位或者个人 停止违法行为,履行法定义务; (七)其他法律、法规、规章规 定的措施。 第三十四条农业行政处罚 证据包括书证、物证、视听资 料、电子数据、证人证言、当事 人的陈述、鉴定意见、勘验笔录 和现场笔录。 证据必须经查证属实,方可作为 农业行政处罚机关认定案件事实 的根据。立案前依法取得或收集 的证据材料,可以作为案件的证 据使用。 以非法手段取得的证据,不得作 为认定案件事实的根据。 第三十五条收集、调取的 书证、物证

33、应当是原件、原物。 Article 35 The documentary evidence and physical evidence collected and obtained shall be the original. If it is indeed difficult to collect and obtain the original, a copy, photocopy, or transcript that corresponds as verified with the original, or a photograph, video recording, or an

34、y other evidence sufficient to represent the shape or content of the original, may be provided. The evidence provider or enforcement officers shall, upon verifying that the copy, photocopy, transcript, and photograph are without error, state their consistency with the original and the providing

35、 date and provenance of the evidence and affix their signature or seal. Article 36 The audiovisual information collected and obtained shall be on the original medium for the relevant information. If it is indeed difficult to obtain the original medium, a copy may be provided, bearing the making

36、 method, making time, maker, and object of evidence. The audio information shall be accompanied by its written form. Article 37 The electronic data collected and obtained shall be on the original medium for the relevant data. If it is indeed difficult to collect the original medium for the rele

37、vant data, evidence may be collected by copying, commissioning an analysis, print perpetuation, taking photographs and making video recordings, and other means, bearing the making method, making time, and maker, among others. An agricultural administrative penalty authority may use an Internet

38、 information system or equipment to collect and perpetuate evidence of violations. The Internet information system or equipment used to collect and fix evidence of violations shall conform to relevant provisions and ensure the authenticity and integrity of the collected and fixed electronic dat

39、a. 收集、调取原件、原物确有困难 的,可以提供与原件核对无误的 复制件、影印件或者抄录件,也 可以提供足以反映原物外形或者 内容的照片、录像等其他证据。 复制件、影印件、抄录件和照片 由证据提供人或者执法人员核对 无误后注明与原件、原物一致, 并注明出证日期、证据出处,同 时签名或者盖章。 第三十六条收集、调取的 视听资料应当是有关资料的原始 载体。调取原始载体确有困难 的,可以提供复制件,并注明制 作方法、制作时间、制作人和证 明对象等。声音资料应当附有该 声音内容的文字记录。 第三十七条收集、调取的 电子数据应当是有关数据的原始 载体。收集电子数据

40、原始载体确 有困难的,可以采用拷贝复制、 委托分析、书式固定、拍照录像 等方式取证,并注明制作方法、 制作时间、制作人等。 农业行政处罚机关可以利用互联 网信息系统或者设备收集、固定 违法行为证据。用来收集、固定 违法行为证据的互联网信息系统 或者设备应当符合相关规定,保 证所收集、固定电子数据的真实 性、完整性。 农业行政处罚机关可以指派或者 膊请具有专门知识的人员或者专 业机构,辅助农业行政执法人员 对与案件有关的电子数据进行调 An agricultural administrative penalty authority may appoint or

41、retain a person with expertise or a specialized institution to assist its agricultural administrative enforcement officers in investigating and collecting case-related electronic data as evidence. 查取证。 Article 38 Agricultural administrative enforcement officers shall question a witness or part

42、y individually and make a transcript of the questioning. 第三十八条农业行政执法 人员询问证人或者当事人,应当 个别进行,并制作询问笔录。 If the transcript of the questioning contains an error or omission, the questioned person shall be allowed to make correction or supplement. The corrected or supplemented part shall be confirmed

43、 by the questioned person by affixing his or her signature, seal or fingerprint. 询问笔录有差错、遗漏的,应当 允许被询问人更正或者补充。更 正或者补充的部分应当由被询问 人签名、盖章或者按指纹等方式 确认。 After the transcript of the questioning has been verified by the questioned person, the questioned person shall give his or her confirmation by af

44、fixing his or her signature, seal, or fingerprint to each page of the transcript or other means. The agricultural administrative enforcement officers shall sign the transcript. If the questioned person refuses to affix his or her signature, seal, or fingerprint, the agricultural administrative e

45、nforcement officers shall state the circumstances in the transcript. 询问笔录经被询问人核对无误 后,由被询问人在笔录上逐页签 名、盖章或者按指纹等方式确 认。农业行政执法人员应当在笔 录上签名。被询问人拒绝签名、 盖章或者按指纹的,由农业行政 执法人员在笔录上注明情况。 Article 39 Agricultural administrative enforcement officers conducting on-site examination or investigation of a case-

46、 related item or site shall so notify as to enable the party to be present and make a transcript of the on-site examination or investigation, and if necessary, may keep records of the circumstances of the scene by taking photographs, making a video recording, or other means. 第三十九条农业行政执法 人员对与案件

47、有关的物品或者场 所进行现场检查或者勘验,应当 通知当事人到场,制作现场检查 笔录或者勘验笔录,必要时可以 采取拍照、录像或者其他方式记 录现场情况。 If the parly refuses to be present, it is impossible to find the party, or the party refuses to affix his or her signature or seal, the agricultural administrative enforcement officers shall make a statement in the

48、transcript, and may invite any other person present as a witness. 当事人拒不到场、无法找到当事 人或者当事人拒绝签名或盖章 的,农业行政执法人员应当在笔 录中注明,并可以请在场的其他 人员见证。 Article 40 Where a specialized issue requires to be tested, inspected, authenticated, assessed, or detennined when an agricultural administrative penalty author

52、an agricultural administrative penalty authority may adopt the method of collecting sample evidence. Agricultural administrative enforcement officers shall prepare documents of the collection of sample evidence and place a seal on the samples, and the enforcement officers and the party shall si

53、gn or seal the documents of the collection of sample evidence. If the party refuses to affix his or her signature or seal, the records of the collection of sample evidence shall be kept by taking photographs, making a video recording, or other means. 第四十一条农业行政处罚 机关收集证据时,可以采取抽样 取证的方法。农业行政执法人员

57、 or is difficult to obtain in the future, agricultural administrative enforcement officers may, with the approval of the person in charge of the agricultural administrative penalty authority, take advance registration and preservation measures for the evidence related to the suspected violation

60、当事人交付先行登 记保存证据通知书和物品清单。 For the advance registration and preservation of relevant evidence, the agricultural administrative enforcement officers shall check the evidence on the spot, make a list, fill in the enforcement documents of advance registration and preservation, to which the agricultu

61、ral administrative enforcement officers and the party affix their signature, seal or fingerprint, and deliver a notice of advance registration and preservation of evidence and the list of items to the party. 第四十三条先行登记保存 物品时,就地由当事人保存的, 当事人或者有关人员不得使用、 销售、转移、损毁或者隐匿。 Article 43 Where an item sub

62、ject to advance registration and preservation is preserved by the party on-site, the party or any relevant person shall not use, sell, transfer, damage, or conceal the item. 就地保存可能妨害公共秩序、公 共安全,或者存在其他不适宜就 地保存情况的,可以异地保存。 对异地保存的物品,农业行政处 罚机关应当妥善保管。 If on-site preservation may interfere with pub

63、lic order or public security, or is otherwise inappropriate, the item may be preserved in a different place. In such a case, the agricultural administrative penalty authority shall properly preserve the item. 第四十四条农业行政处罚 机关对先行登记保存的证据,应 当自采取登记保存之日起七日内 作出下列处理决定并送达当事 人: Article 44 For evidenc

64、e registered and preserved in advance, the agricultural administrative penalty authority shall, within seven days of registration and preservation, make and serve on the party the following disposition decisions: (一)根据情况及时采取记录、 复制、拍照、录像等证据保全措 施; (1) Promptly adopting evidence preservation mea

65、sures such as keeping records, making a copy, taking photographs, and making a video recording based on the circumstances. (二)需要进行技术检测、检 验、鉴定、评估、认定的,送交 有关机构检测、检验、鉴定、评 估、认定; (2) Submitting to the relevant institutions for testing, inspection, authentication and identification, assessment, and

66、 determination as needed. (三)对依法应予没收的物品, 依照法定程序处理; (3) Confiscating the item according to the statutory procedures, if the law so requires. (四)对依法应当由有关部门处 理的,移交有关部门; (4) Transferring to the relevant department for handling, if the law so requires. (五)为防止损害公共利益,需 要销毁或者无害化处理的,依法 进行处理; (5) Destroying or harmlessly disposing of the evidence according to the law, if in the public interest. (六)不需要继续登记保存的, 解除先行登记保存。 第四十五条 农业行政处罚 机关依法对涉案场所、设施或者 财物采取查封、扣押等行政强制 措施,应当在实施前向农业行政 处罚机关负责人
