1、 员工离职管理制度简洁明了篇一:员工离职管理制度 员工离职管理制度 第一章 总则 第一条 为规范离职管理工作,维护公司和离职员工的合法权益,特制定本管理制度。 第二条 本制度适用于所有员工,不论何种原因离职,均依本办法办理,若有特例,由总经理签字认可。 第三条 公司人力资源部是离职管理的归口部门,各部门配合、参与。 第二章 离职分类及要求 第四条 辞职。员工因个人原因辞去工作: (一)员工因故辞职应填写员工辞职申请表,并报所在部门负责人(或指定具有人事处理权力的专人)审阅批示意见后转交公司人力资源部处理; (二)公司员工辞职应提前一个月以书面形式申请; (三)试用期员工离职申请应提前3日申请;

2、 (四)下列情况参照执行: 1员工因犯错或过失须引咎辞职的; 2员工表现较差,为留情面而劝其离职的; 3员工单方面不续签劳动合同的。 第五条 自动离职。员工有下列情况均视为自动离职: (一)无故旷工3日以上; (二)假期满后无故不销假,超过5天以上;(三)受到处分到期后超过3天以上,拒不到部门报到的; (四)公司没有降低原合同待遇,但在规定的时间内拒绝签订新的劳动合同的; (五)员工未按规定时间书面通知公司辞职的; (六)接到工作调(变)动通知后超过5天拒不报到上岗的; (七)未按规定办理离职手续的; (八)工伤评残后,个人提出结算一次性就业补助的。 第六条 合同到期离职.因劳动合同到期而没有

3、续签或变更,而自动终止劳动(来自:WwW。CssYq。com 书业 网:员工离职管理制度简洁明了)关系: (一)原劳动合同即将到期,双方任何一方单方面提出不再续签劳动合同; (二)原劳动合同即将到期,双方协商不再续签劳动合同; (三)原劳动合同即将到期,员工提出过高要求而致使劳动合同不能如期签订。 第七条 辞退(解雇):公司强制终止劳动合同的情形,以公司发文公告为依据,由公司人力资源部负责处理: (一)因各种原因不能胜任公司按排的工作,或经转岗和培训后仍然无法继续胜任工作的; (二)月度考核连续3次不合格,或年度考核不合格,达到末位淘汰标准的; (三)公司因转产、兼并重组(整)、经营发生困难等

4、原因,经向工会和劳动主管部门申请确须裁减人员时; (四)公司生产经营难以为继,申请破产或经人民法院宣告破产需解散人员时; (五)公司管理制度规定或劳动合同约定的条件出现时。 第八条 开除。公司强制终止劳动合同的情形,以公司发文或公告为准,由人力资源部按文件精神办理: (一)严重违反公司规章制度,达到开除条件者; (二)连续两次受到记过处分,或累计受到记大过处分2次以上者,或累计受到记过处分3次以上者; (三)因指挥或操作失误(个人承担同等或主要责任)给公司造成重大损失(直接损失超过20000元,含人身、设备、安全等事故),或隐瞒事故、毁灭证据,或拒不按规定接受处罚、赔偿损失的; (四)利用职务

5、之便损公肥私,或经营、管理等关键岗位收受贿赂,达到开除条件的; (五)管理人员违反任职管理办法、任职行为的若干规定、非公活动实行“上礼下”的若干规定、员工婚丧嫁娶等活动相关规定,经戒勉谈话后仍不思悔改的; (六)法律法规规定符合开除的情形。 第九条 退(职)休: (一)达到规定退休年龄或已享受退休待遇的; (二)因工伤(含职业病)而退出工作岗位的; (三)因患重病不能继续从事工作而退出工作岗位或已享受病退待遇的; (四)通过员工子女顶岗置换办法而退职的老员工; (五)法律法规规定应当退职的情形.第十条 离职程序: 第三章 离职面谈 第十一条 部门经理(负责人)进行离职谈话: 员工离职时,该部门

6、经理与离职人进行谈话;如果有必要,可以请其他人协助,谈话须完成下列内容: (一)审查文件、资料及工具的所有权; (二)审查其了解公司秘密的程度; (三)审查其掌管的工作进度和角色; (四)阐明公司和员工的权力和义务; (五)记录离职谈话清单,经员工和谈话经理共同签字,并分存公司和员工档案; (六)如果是员工提出辞职,部门经理应积极沟通,了解员工辞职的真正原因。努力挽留绩效良好的员工,探讨改善其工作环境、条件和待遇的可能性。 第十二条 人力资源部经理或人事专员进行离职谈话: 员工离职时,人力资源部经理(非骨干员工可由人事专员代理)应与离职人进行谈话,相关谈话内容包括但不仅限于: (一)审查其劳动

7、合同履行情况,了解离职类型; (二)审查员工的工资和福利状况; (三)回答员工可能有的疑问和意见; (四)征求对所在岗位、同事、直接上级、间接上级的 评价与意见; (五)征求对公司的评价及建议; (六)如果是员工提出辞职,应积极沟通,了解辞职的真正原因。努力挽留绩效良好的员工,如遇骨干或管理人员辞职,还应了解其对继任者的建议和看法. (七)告知员工需办理哪些离职手续; (八)记录离职谈话清单,经员工和谈话人共同签字,并分存公司和员工档案。 第十三条 离职员工因故不能亲临公司会谈,应尽可能通过电话交谈. 第十四条 对面谈中涉及的有价值信息应及时验证和跟踪处理,重大信息应及时上报。 第十五条 若出

12、移交至公司财务部。 3以上各项交接须填写离职交接表,均应由交接人、接管人签字确认,并经办公室审核、备案后方可视为交接完成. 第十三条 辞职员工结算款项 1结算工资; 2应得到但尚未使用的年休假时间; 3应付未付的奖金、佣金; 4辞职补偿金,按国家相关规定执行; 5公司拖欠员工的其他款项; 6须扣除以下项目: (1)员工拖欠未付的借款、罚金; (2)员工对未交接手续的赔偿金。 第十四条 关系转移 1转移前提 (1)交接工作全部完成(以离职交接表签字为准); (2)违约金、赔偿金等结算完成(以离职交接表签字为准)。 2转移内容 (1)档案关系; (2)社保关系; (3)开具离职证明。 北京易中创业
