4、ace,theEmployershallpaytheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations.4.WorkingHours&Rest&Vocationa.ThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweek.b.TheEmployeeis
5、entitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthecompanysworkrules.c.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynote
6、xceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.5.SocialSecurity&Welfarea.TheEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemploymentinsurance,medicalin
7、suranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations.b.DuringtheperiodoftheContract,theEmployeeswelfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofP.R.C.6.WorkingProtection&WorkingConditionsa.TheEmployershouldprovidetheEmployeewithoccupationalsafetyandhealthcondi
8、tionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.b.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrainingandacquirequalif
9、icationsforsuchspecialoperations.c.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.7.LabourDisciplinea.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,theEmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee;b.TheEmploy
10、eeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.c.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;ThisobligationofconfidentialityshallsurvivetheterminationofthisContractforape
11、riodoftwo(2)years.8.Termination,Modification,RenewandDischargeoftheContracta.TherelevantclausesoftheContractmaybemodifiedbytheparties:i.Thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;ii.Duetotheforcemajeure,theContractcannotbeexecuted;iii.Therelevantlawsandregulationshavebeen
12、modifiedorabolishedbythetimeofsigningtheContract.b.TheContractmaybeautomaticallyterminated:i)ThisContractisnotrenewedattheexpirationofthisContract;ii)TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii)ThedeathoftheEmployeeoccurs;iv)Theforcemajeuretakesplace;v)Theconditionsoftermina
13、tionagreedintheContractbythepartiesarise.c.TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;d.TheContractmaybedischargedthroughconsultationbytheparties;e.TheContractmaybedischargedbytheEmployerwithimmediateeffectandtheEm

15、edbyphysicallabourforitsmisfeasancev.TheEmployeeisbeingchargedwithcriminaloffences:f.TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:i.TheEmployeefailsillorisinjuredto(otherthanduetowork)andaftercompletionofmedicaltreatment,isnotabletoperformhispreviousfunct
16、ionoranyotherfunctiontheEmployerassignstohim;ii.TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iii.ThecircumstanceshavemateriallychangedfromthedatethisContractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,ho

22、TheEmployershallpaytheeconomiccompensationtotheEmployeriftheContractisterminatedconformingto8.d,8.f,8.h.i-8.h.iv.AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingto8.f.i.9.BreachLiabilitiesa.Duetoeitherpartysfault,ifbreachingtheContract,thapartyshallunderta
23、kethebreachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.b.Duetoeitherpartysfault,ifbreachingtheContracttodamagetheotherparty.Thedamageshouldbecompensatedbythefaultypartyaccordancewit
