4、pment.Article 2 ForpurposesofthisLaw,environmentalnoisemeansthesoundthatisemittedinthecourseofindustrialproduction,construction,transportationandsocialactivitiesandthatimpairsthelivingenvironmentoftheneighbourhood.Environmentalnoisepollution,asusedinthisLaw,meansthattheenvironmentalnoiseemittedexcee

5、dstheenvironmentalnoiseemittedlimitssetbytheStateontheenvironmentalnoiseemittedandimpairspeoplesdailylife,workandstudy.Article 3 ThisLawshallapplytopreventionandcontrolofenvironmentalnoisepollutionintheterritoryofthePeoplesRepublicofChina.ThisLawshallnotapplytopreventionandcontrolofnoisehazardsincur

6、redinthecourseofproductionorbusinessoperationoneisengagedin.Article 4 TheStateCouncilandlocalpeoplesgovernmentsatvariouslevelsshallincorporatepreventionandcontrolofenvironmentalnoisepollutionintotheirenvironmentalprotectionplansandadopteconomicandtechnologicalpoliciesandmeasurestoprotecttheacoustice

7、nvironment.Article 5 Localpeoplesgovernmentsatvariouslevelsshall,whendrawingupurbanandruraldevelopmentplans,givefullconsiderationtotheimpactofnoiseemittedbyconstructionprojectsandregionaldevelopmentandrenovationprojectsonthelivingenvironmentoftheneighbourhood,makeunifiedplansandrationallyarrangethel

8、ayoutofthefunctionareasandthebuildings,inordertopreventorminimizeenvironmentalnoisepollution.Article 6 ThecompetentadministrativedepartmentforenvironmentalprotectionundertheStateCouncilshallexerciseunifiedsupervisionandadministrationofthepreventionandcontrolofenvironmentalnoisepollutionthroughoutthe

9、country.Thecompetentadministrativedepartmentsforenvironmentalprotectionofthelocalpeoplesgovernmentsatorabovethecountylevelshallexerciseunifiedsupervisionandadministrationofthepreventionandcontrolofenvironmentalnoisepollutionwithintheirrespectiveadministrativeregions.Thecompetentadministrativedepartm

10、entsforpublicsecurity,communications,railwaysandcivilaviationaswellasharboursuperintendencyadministrationatvariouslevelsshall,withintheirrespectivefunctionsandduties,exercisesupervisionandadministrationofthepreventionandcontrolofnoisepollutionbytrafficandsocialactivities.Article 7 Allunitsandindivid

11、ualsshallhavetheobligationtoprotecttheacousticenvironmentandshallhavetherighttoinformagainstandaccuseanyunitorindividualthatpollutestheenvironmentwithnoise.Article 8 TheStateencouragesandsupportsscientificresearchandtechnologicaldevelopmentrelatingtothepreventionandcontrolofenvironmentalnoisepolluti

12、on,promoteswideadoptionofadvancedtechnologiesinthisareaanddisseminatesscientificknowledgeaboutpreventionandcontrolofsuchpollution.Article 9 Thepeoplesgovernmentsshallgiveawardstounitsandindividualsthathaveachievedoutstandingsuccessesinpreventingandcontrollingenvironmentalnoisepollution.ChapterIISupe

13、rvisionandAdministrationofthePreventionandControlofEnvironmentalNoisePollutionArticle 10 ThecompetentadministrativedepartmentforenvironmentalprotectionundertheStateCouncilshallestablishnationalstandardsforacousticenvironmentalqualityfordifferentfunctionareas.Localpeoplesgovernmentsatorabovethecounty

14、levelshall,inaccordancewiththenationalstandardsforacousticenvironmentalquality,dividetheirrespectiveadministrativeregionsintodifferentzonesforapplicationofdifferentstandardsforacousticenvironmentalqualityandexercisecontrolaccordingly.Article 11 Thecompetentadministrativedepartmentforenvironmentalpro

15、tectionundertheStateCouncilshall,inaccordancewiththenationalstandardsforacousticenvironmentalqualityandtheStateseconomicandtechnologicalconditions,fixnationallimitsforenvironmentalnoiseemission.Article 12 Whendeterminingthelayoutofbuildings,urbanplanningdepartmentsshall,inaccordancewiththenationalst

16、andardsforacousticenvironmentalqualityandthesoundinsulationdesignstandardsforcivilarchitecture,decideontherationaldistancebetweenthestructuresandthetraffictrunklinesinordertokeepthestructuresawayformnoiseaswellastherequirementsonplanninganddesignaccordingly.Article 13 Everyprojectunderconstruction,r

17、enovationorexpansionmustconformtotheregulationsoftheStategoverningenvironmentalprotection.Whereaconstructionprojectmightcauseenvironmentalnoisepollution,theunitundertakingtheprojectmustprepareanenvironmentalimpactstatementwhichincludesthemeasuresittakestopreventandcontrolsuchpollution,andsubmitit,fo

18、llowingtheproceduresprescribedbytheState,tothecompetentadministrativedepartmentforenvironmentalprotectionforapproval.Theenvironmentalimpactstatementshallincludethecommentsandsuggestionsoftheunitsandresidentsintheplacewheretheconstructionprojectislocated.Article 14 Facilitiesforpreventionandcontrolof

19、environmentalnoisepollutionmustbedesigned,builtandputintousesimultaneouslywiththemainpartofaconstructionproject.Beforeaconstructionprojectisputintoproductionoruse,itsfacilitiesforpreventionandcontrolofenvironmentalnoisepollutionmustbeinspectedbythecompetentadministrativedepartmentforenvironmentalpro

20、tectionthatoriginallyapprovedtheenvironmentalimpactstatement;ifsuchfacilitiesfailtomeettherequirementsoftheState,theconstructionprojectmaynotbeputintoproductionoruse.Article 15 Enterprisesandinstitutionsthatproduceenvironmentalnoisepollutionmustmaintainnormaloperationofthefacilitiesforpreventionandc

21、ontrolofsuchpollution;whoeverintendstodismantleorleaveidlesuchfacilitiesmustreportthematterinadvancetothecompetentadministrativedepartmentforenvironmentalprotectionofthelocalpeoplesgovernmentatorabovethecountylevelforapproval.Article 16 Unitsthatproduceenvironmentalnoisepollutionshalltakemeasurestoc

22、ontrolitandpayfeesforexcessiveemissionofsuchpollutionaccordingtotheregulationsoftheState.Thefeescollectedfromexcessiveemissionofpollutionmustbeusedforpreventionandcontrolofpollutionandmaynotbeappropriatedforanyotheruse.Article 17 Anyenterpriseorinstitutionthatproducesseriousenvironmentalnoisepolluti

23、oninanareawherenoise-sensitivestructuresareconcentratedshallbeorderedtocontrolthepollutionwithinatimelimit.Theunitthatisorderedtocontrolthepollutionwithinatimelimitmustaccomplishthetaskonschedule.Adecisiononsuchcontrolshallbemadebythepeoplesgovernmentatorabovethecountylevelwithinthelimitsofitspowerg

24、rantedbytheStateCouncil.Inthecaseofasmallenterpriseorinstitution,thedecisiononcontrollingpollutionwithinatimelimitmaybemadebythecompetentadministrativedepartmentforenvironmentalprotectionthatisauthorizedbyapeoplesgovernmentatorabovethecountylevelwithinthelimitsofitspowergrantedbytheStateCouncil.Arti

25、cle 18 TheStateappliesaneliminationsystemforout-datedequipmentthatproducesseriousenvironmentalnoisepollution.ThecompetentdepartmentforcomprehensiveeconomicandtradeaffairsundertheStateCouncilshall,togetherwithrelevantdepartmentsoftheStateCouncil,publishcatalogsofequipmentthat,becauseoftheseriousenvir

26、onmentalnoisepollutionitproduces,isforbiddentobemanufactured,soldorimportedwithinatimelimit.Themanufacturers,sellersandimportersmuststopmanufacturing,sellingorimportingtheequipmentincludedinthecatalogsmentionedintheprecedingparagraph,withinthetimelimitsetbythecompetentdepartmentforcomprehensiveecono

27、micandtradeaffairsundertheStateCounciltogetherwiththerelevantdepartmentsoftheStateCouncil.Article 19 Inthecasewheresporadicstrongnoiseistrulyunavoidableinproductionconductedwithinanurbanarea,themattermustfirstbeappliedtothelocalpublicsecurityorganforapproval.Upongivingapproval,thelocalpublicsecurity

28、organshallmakeitknowntothepublic.Article 20 ThecompetentadministrativedepartmentforenvironmentalprotectionundertheStateCouncilshallestablishasystemformonitoringenvironmentalnoise,establishmonitoringstandards,andsetupamonitoringnetworkwiththerelevantdepartments.Theenvironmentalnoisemonitoringinstitut

29、ionsshall,asrequired,submitreportsontheenvironmentalnoisemonitoringresultstothecompetentadministrativedepartmentforenvironmentalprotectionundertheStateCouncil.Article21Thecompetentadministrativedepartmentsforenvironmentalprotectionofthepeoplesgovernmentsatorabovethecountylevelandotherdepartmentsorin

30、stitutionsinchargeofsupervisionandadministrationofthepreventionandcontrolofenvironmentalnoisepollutionshall,withinthelimitsoftheirrespectivefunctionsandduties,havethepowertoconducton-the-spotinspectionoftheunitsthatemitenvironmentalnoisewithintheareasundertheirjurisdiction.Theunitsunderinspectionmus

31、tgiveatrueaccountoftheactualsituationandprovidethenecessaryinformation.Thedepartmentsorinstitutionsconductingsuchinspectionshallkeepconfidentialthetechnologicalandbusinesssecretsoftheinspectedunits.Theinspectorsshallproducetheircredentialsbeforeconductingon-the-spotinspection.ChapterIIIPreventionand

32、ControlofIndustrialNoisePollutionArticle22ForpurposesofthisLaw,industrialnoisemeansthesoundthatisemittedbythepermanentequipmentusedinthecourseofindustrialproductionandthatimpairsthelivingenvironmentoftheneighbourhood.Article23Theindustrialnoiseemittedtothelivingenvironmentoftheneighbourhoodwithinanu

33、rbanareashallbekeptwithinthelimitssetbytheStateonemissionofenvironmentalnoisewithintheboundaryofanindustrialenterprise.Article24Anyindustrialenterprisethatproducesenvironmentalnoisepollutionduetotheuseofpermanentequipmentinthecourseofindustrialproductionmust,inaccordancewiththeregulationsofthecompet

34、entadministrativedepartmentforenvironmentalprotectionundertheStateCouncil,reporttothecompetentadministrativedepartmentforenvironmentalprotectionofthelocalpeoplesgovernmentatorabovethecountylevelthetypesandquantityofitsequipmentthatproducesenvironmentalnoisepollution,thenoiselevelproducedundernormalo

35、perationandthefacilitiesinstalledforpreventionandcontrolofsuchpollution,andprovidetechnicalinformationrelatingtothepreventionandcontrolofnoisepollution.Anyindustrialenterprisethatintendstomakeasubstantialchangeinthetypesorquantityoftheequipmentthatproducesenvironmentalnoisepollution,inthenoiselevelo

36、rfacilitiesforpreventionandcontrolofsuchpollutionmustsubmitareportwithoutdelayandtakepreventionandcontrolmeasuresasitshould.Article25Industrialenterprisesthatproduceenvironmentalnoisepollutionshalltakeeffectivemeasurestominimizetheimpactofnoiseonthelivingenvironmentoftheneighbourhood.Article26Withre

37、gardtoindustrialequipmentthatmightproduceenvironmentalnoisepollution,therelevantcompetentdepartmentsundertheStateCouncilshall,inaccordancewiththerequirementsforprotectionoftheacousticenvironmentandtheStateseconomicandtechnologicalconditions,graduallyincludethenoiselevellimitsinthenationalstandardsan

38、dtradestandardsforproductsestablishedaccordingtolaw.Thelevelofnoiseemittedbytheindustrialequipmentinoperationmentionedintheprecedingparagraphshallbespecifiedinrelevanttechnicaldocuments.ChapterIVPreventionandControlofConstructionNoisePollutionArticle27Constructionnoise,asusedinthisLaw,meansthesoundt

39、hatisemittedinthecourseofconstructionandthatimpairsthelivingenvironmentoftheneighbourhood.Article28TheconstructionnoiseemittedtothelivingenvironmentoftheneighbourhoodwithinanurbanareashallbekeptwithinthelimitssetbytheStateontheemissionofenvironmentalnoisewithintheboundaryofaconstructionsite.Article2

40、9Theunitinchargeofaconstructionprojectwhichmayproduceenvironmentalnoisepollutionduetotheuseofmachinesandotherequipment,mustreport,15daysbeforecommencementofconstruction,tothecompetentadministrativedepartmentforenvironmentalprotectionofthelocalpeoplesgovernmentatorabovethecountylevelthenameoftheproje

41、ct,theconstructionsite,thelengthoftimeneededforcompletionoftheproject,thepossiblelevelofenvironmentalnoiseandthemeasurestakenforpreventionandcontrolofsuchpollution.Article30Inanurbanareawherenoise-sensitivestructuresareconcentrated,constructionoperationthatproducesenvironmentalnoisepollutionisforbid

42、denatnight,withtheexceptionofrushrepairs,rescueoperationsorcontinuedoperationsrequiredbyproductiontechniquesorbyspecialneeds.Forcontinuedoperationduetospecialneeds,theremustbeapermitissuedbythepeoplesgovernmentatorabovethecountylevelorbytherelevantcompetentdepartmentunderit.Nightoperationmentionedin

43、theprecedingparagraphmustbemadeknowntotheresidentsintheneighbourhood.Chapter VPreventionandControlofTrafficNoisePollutionArticle31Trafficnoise,asusedinthisLawmeansthesoundthatisemittedbysuchmeansoftransportasmotorvehicles,locomotives,motorvesselsandaircraftinmotionandthatimpairsthelivingenvironmento

44、ftheneighbourhood.Article32Itisforbiddentomanufacture,sellorimportautomobilesthatemitnoisebeyondthelimitssetonnoiselevel.Article33MufflersandhornsofmotorvehiclesdrivenwithinurbanareasmustmeettherequirementsoftheState.Motorvehiclesmustberegularlyservicedandkeptingoodrepairinordertomaintainexcellentte

45、chnicalperformanceandhelppreventandcontrolenvironmentalnoisepollution.Article34Whenmotorvehiclesaredriveninurbanareas,motorvesselsarenavigatedalonginlandriversinurbanareas,andlocomotivesarerunningthroughorenteringurbanareasorsanatoriumareas,theirsound-makingapparatusmustbeusedincompliancewithregulat

46、ions.Alarmingsirensmustbeinstalledonsuchmotorvehiclesaspolicecars,fireengines,engineeringrescuevehiclesandambulancesandusedincompliancewiththeregulationsofthepublicsecuritydepartmentundertheStateCouncil.Itisforbiddentousethealarmingsirensunlesswhenurgenttasksareperformed.Article35Thepublicsecurityor

47、gansofmunicipalpeoplesgovernmentsmay,inlinewiththeneedtoprotectthelocalacousticenvironmentoftheurbanareas,demarcateno-motor-vehicleorno-hornroadsectionsandhours,andmakethemknowntothepublic.Article36Tobuildexpressways,urbanoverheadroadandlight-tractlinesthattraverseareaswherethereareconcentratednoise

48、-sensitivestructuresandthatmightproduceenvironmentalnoisepollution,soundbarriersshallbeerectedorothereffectivemeasuresshallbetakentocontrolenvironmentalnoisepollution.Article37Tobuildnoise-sensitivestructuresonbothsidesofexistingurbantraffictrunklines,theconstructionunitshall,inaccordancewiththeregu

49、lationsoftheState,keepsuchstructuresacertaindistanceawayfromthelinesandtakemeasurestomitigateoravoidtheimpactoftrafficnoise.Article38Whereloudspeakersareusedtodirectoperationsattransportterminals,railwaymarshalyards,ports,docksandairports,thesoundvolumeshallbecontrolledsoastominimizethenoiseimpacton

50、thelivingenvironmentoftheneighbourhood.Article39Wherelocomotiveswhentraversingurbanresidential,culturalandeducationdistrictsproduceenvironmentalnoisepollution,thelocalmunicipalpeoplesgovernmentsshallgettherailwaydepartmentsandotherrelevantdepartmentstogethertoworkoutplansformitigatingsuchpollution.T

51、herailwaydepartmentsandotherrelevantdepartmentsshallactinaccordancewithsuchplansandtakeeffectivemeasurestomitigateenvironmentalnoisepollution.Article40Withtheexceptionoftake-off,landingorothersituationsasprovidedforbylaw,nocivilaircraftmayflyovertheurbanareasofcities.Themunicipalpeoplesgovernmentssh

52、alldemarcateareasinthevicinityofobstacleclearancezonesforthetake-offandlandingofaircraftwhereconstructionofnoise-sensitivestructuresisrestricted.Tobuildnoise-sensitivestructureswithinsuchareas,theconstructionunitsshalltakemeasuretomitigateoravoidtheimpactofthenoiseemittedbyaircraftinmotion.Thecivila

53、viationdepartmentshalltakeeffectivemeasurestomitigateenvironmentalnoisepollution.Chapter VIPreventionandControlofPollutionbyNoiseofSocialActivitiesArticle41Noiseofsocialactivities,asusedinthisLaw,meansthesoundthatisemittedbyman-conductedactivitiesandthatimpairsthelivingenvironmentoftheneighbourhood,

54、otherthanindustrial,constructionandtrafficnoise.Article42Acommercialenterprisethat,inanurbanareawherenoise-sensitivestructuresareconcentrated,produceenvironmentalnoisepollutionastheresultofitsuseofpermanentequipmentinthecourseofcommercialactivitiesmust,inaccordancewiththeregulationsofthecompetentadm

55、inistrativedepartmentforenvironmentalprotectionundertheStateCouncil,reporttothecompetentadministrativedepartmentforenvironmentalprotectionofthelocalpeoplesgovernmentatorabovethecountyleveltheconditionoftheequipmentthatproducesenvironmentalnoisepollutionandprovideinformationaboutthefacilitiesforpreve

56、ntionandcontrolofsuchpollution.Article43Noiselevelattheboundaryofnewly-constructedprofit-makingculturalandentertainmentcentersmustbekeptwithinthelimitsofenvironmentalnoiseemissionsetbytheState.Nocompetentadministrativedepartmentforculturemayissueculturaloperationlicenceandnoadministrativedepartmentf

57、orindustryandcommercemayissuebusinesslicencetothecentersthatfailtokeepsuchemissionwithinthelimits.OperatorsandmanagersofculturalandentertainmentcentersmusttakeeffectivemeasurestokeepnoiseattheboundaryfromexceedingthelimitssetbytheStateonemissionofenvironmentalnoise.Article 44 Incommercialactivitiesh

58、igh-pitchloudspeakersandotherloud-noiseinstrumentsareforbiddentobeusedforattractingcustomers.Whenusingsuchequipmentandfacilitiesasair-conditionersandcoolingtowersincommercialactivitieswhichmightproduceenvironmentalnoisepollution,theoperatorsandmanagersshalltakemeasurestokeepthenoiseattheboundaryfrom

59、exceedingthelimitssetbytheStateonemissionofenvironmentalnoise.Article 45 Allunitsandindividualsareforbiddentousehigh-pitchloudspeakersinurbanareaswherenoise-sensitivestructuresareconcentrated.Whereaudioapparatusthatmightproducesuchexcessivesoundvolumeastoimpairthelivingenvironmentoftheneighbourhooda

60、reusedforentertainmentsarrangedorgatheringsheldatsuchpublicplacesasstreets,squaresorparksinurbanareas,theregulationsofthelocalpublicsecurityorganmustbeobserved.Article 46 Whoeveruseshouseholdappliancesormusicalinstrumentsorholdsotherindoorentertainmentactivitiesshallkeepthesoundvolumeundercontrolort

61、akeothereffectivemeasurestoavoidproducingenvironmentalnoisepollutiontotheneighbours.Article 47 Whoevermakesindoordecorationandrefittinginaresidentialbuildingthatisalreadycompletedanddeliveredforuseshalldosoinrestrictedhoursandtakeothereffectivemeasurestomitigateoravoidproducingenvironmentalnoisepoll

62、utiontotheneighbours.ChapterVIILegalLiabilityArticle48Anyonewho,inviolationoftheprovisionsofArticle14ofthisLaw,putsintoproductionoruseaconstructionprojectbeforethenecessaryfacilitiesforpreventionandcontrolofenvironmentalnoisepollutionhavebeencompletedormeettherequirementslaiddownbytheState,shallbeor

63、deredtostopproductionoruseandmayalsobefinedbythecompetentadministrativedepartmentforenvironmentalprotectionthatoriginallyapprovedtheenvironmentalimpactstatementregardingthisconstructionproject.Article49Anyonewho,inviolationoftheprovisionsofthisLaw,refusestoreportormakesafalsereportontheparticularssu

64、bjecttoreportregardingtheenvironmentalnoiseemission,maybegivenadisciplinarywarningorfinedinlightoftheseriousnessoftheviolationbythecompetentadministrativedepartmentforenvironmentalprotectionofthelocalpeoplesgovernmentatorabovethecountylevel.Article50Anyenterpriseorinstitutionthat,inviolationofthepro

65、visionsofArticle15ofthisLaw,dismantlesorleavesidlethefacilitiesforpreventionandcontrolofenvironmentalnoisepollutionwithoutapprovalofthecompetentadministrativedepartmentforenvironmentalprotection,therebyemittingenvironmentalnoiseinexcessofthelimitsprescribed,shallbeorderedtosetitrightandalsobefinedbythecompetentadministrativedepartmentforenvironmentalprotectionofthelocalpeoplesgovernmentatorabovethecountylevel.Article51Anyunitthat,inviolationoftheprovisionsofArticle16ofthisLaw,failstopay,asrequiredbytheState,feesforexcessiveemissionofnoise,maybegivenad
