1、建筑合同(中英版) 建筑合同CONTRACT FOR CONSTRUCTION甲方 (Party A): 建筑公司名称 (Name of construction company)乙方 (Party B): 业主名称 (Name of owner)1. 项目简介 Project Overview甲方同意，按照双方协议的约定，在地址建设项目名称 。Party A agrees to construct Project Name at Address in accordance with the terms of this agreement.2. 工程期限 Construction Schedu

2、le本工程的施工期限为起始日期至完成日期（具体工期以甲方发布的工作计划为准）。如果乙方需要延长工作期限，乙方必须提前向甲方通知。The construction period of this project is from Start Date to Completion Date (the specific construction schedule shall be subject to the work schedule issued by Party A). If Party B needs to extend the construction period, it must noti

3、fy Party A in advance.3. 报酬及支付方式 Compensation and Payment3.1 甲方对本工程的全部报酬为定额/合同总金额，包括现金、支票或转账方式支付。如下：Party A will receive full compensation of Fixed Sum/Total Contract Amount for the completion of the project, including payment by cash, check or transfer, as follows:（1） 项目启动时，乙方应支出预付款数额作为本工程启动资金。当乙方同

4、意工作计划和进度报告时，甲方可领取进度款数额的付款。(1) At the start of the project, Party B shall pay Advance Payment Amount as the initial capital for the project. When Party B agrees with the work schedule and progress report, Party A can receive payment of Progress Payment Amount.（2） 乙方将在工程完成之前的要求付款时间前，向甲方支付尾款数额。(2) Part

5、y B shall pay Final Payment Amount to Party A prior to Required Payment Time before the completion of the project.3.2 乙方必须按照约定的时间内付款，逾期未付的，按照每天罚款百分比%的标准向甲方支付滞纳金。Party B must pay within the agreed time, and if payment is overdue, Party B shall pay Party A a late fee of Late Fee Percentage% per day.4.

6、 设计和建造规范 Design and Building Standards双方同意，所有的建筑和工程必须符合国家和地方法规的要求和标准。甲方对工程的设计和建造质量负责。Both parties agree that all buildings and construction must comply with national and local regulations and standards. Party A is responsible for the quality of the projects design and construction.5. 变更 Change Order

7、s如果乙方要求对工程的设计或施工进行更改，乙方必须事先向甲方提出书面的变更订单，并且甲方必须同意此变更订单。变更订单必须包括新的计划、工程进度、费用和工期等详细信息。If Party B requests changes to the projects design or construction, Party B must submit a written change order to Party A in advance, and Party A must agree to such change order. The change order must include detailed

8、 information such as a new plan, construction schedule, costs and timelines.6. 延误和中断 Delays and Interruptions如果因不可抗力事件（例如天灾、战争、罢工等）而导致本工程的施工中断，乙方须在事件解除后尽快与甲方沟通，重新安排工程计划和进度。If an event of force majeure (such as a natural disaster, war, strike, etc.) interrupts the construction of this project, Party

9、B must communicate with Party A as soon as possible after the event is resolved, and reschedule the project plan and schedule.7. 合同终止 Termination of the Contract7.1 如果甲方没有在约定的工作计划和进度报告中保证合理的进展，乙方可以提前通知甲方，解除合同。If Party A fails to ensure reasonable progress in the agreed work schedule and progress rep

10、ort, Party B may give notice to terminate the contract.7.2 如果甲方没有根据本合同的规定履行其责任，乙方可以要求甲方重新履行或解除合同。If Party A fails to fulfill its obligations according to this contract, Party B may require Party A to fulfill its obligations again or terminate the contract.8. 知识产权 Intellectual Property Rights甲方对所有与本工

11、程相关的知识产权拥有全部权利。如果甲方在建造工程中用到乙方的设备或技术，并且甲方将这些设备或技术整合到工程中，双方都必须就此达成书面协议。Party A owns all intellectual property rights related to this project. If Party A uses Party Bs equipment or technology in the construction of the project, and Party A integrates these equipment or technology into the project, both

12、 parties must reach a written agreement on this matter.9. 适用法律和争议解决法律适用法律和争议解决本合同受相关的国家法律管辖。如发生争议，双方应尽快协商并解决。如果协商无果，则争议将提交给有管辖权的法院或仲裁机构进行仲裁解决。This agreement is governed by the relevant laws of Country. In the event of a dispute, both parties shall try to negotiate and resolve it as soon as possible. If the negotiation fails, the dispute shall be submitted to an arbitration institution or jurisdictional court for arbitration or resolution.
