3、and other relevant regulations and laws, and with the intermediary services ofParty C, Party A and Party B agree to enter into this Contract in equal status and voluntarily with articles as follow:第一条 房屋基本情况 Article 1: General states of the house(一)房屋坐落于市区(县)街道办事处(乡镇),建筑面积平方米。(a) The house is locate

5、e), the munimentNO.:, or the certificate of obtaining the house:, House-ownersname (Public houses lessee or house buyer):,Whether the house has been mortgaged (YES/NO).第二条 房屋租赁情况与登记备案 Article 2: Rental situation and registration(一)租赁用途:;如租赁用途为居住的,居住人数为:,最多不超过人。(a) Rental purposes: If the rental purp

6、ose is for residence, the number of inhabitant is, and should not exceedingpersons.(二)如租赁用途为居住的,甲方应自与乙方订立本合同之日起7日,到房屋所在地的社区来京人员和出租房屋服务站办理房屋出租登记手续。对多人居住的,乙方应将居住人员情况告知甲方,甲方应建立居住人员登记簿,并按规定报送服务站。本合同变更或者终止的,甲方应自合同变更或者终止之日起5日,到房屋所在地的社区来京人员和出租房屋服务站办理登记变更、注销手续。在本合同有效期,居住人员发生变更的,乙方应当自变更之日起2日告知服务站,办理变更登记手续。居住

7、人员中有外地来京人员的,甲方应提供相关证明,督促和协助乙方到当地公安派出所办理暂住证;居住人员中有境外人员的,(甲方 /乙方)应自订立本合同之时起24小时到当地公安派出所办理住宿登记手续。租赁用途为非居住的,甲方应自订立房屋租赁合同之日起30日,到房屋所在地的房屋行政管理部门办理房屋租赁合同备案手续。If the rental purposes is for residence, from the date when this Contract has been set up, within 7 days, Party A should go to the Community Service

8、Station for Foreigner and House Lease (hereinafter refers to as the “station”) to have the house lease contract registered. If the inhabitant is more than one person, Party B must inform the situation of inhabitants to Party A. On the other hand, Party A must establish a register for inhabitants, an

9、d send it to the Station complying with regulation. If this contract has been amended or terminated, party A should go to the Station to change or logout the registration within 5 days. In the period of validity, provided the inhabitants have changed, from the date of change, within 2 days, Party B

10、must inform the Service Station and change the registration.Party A should supply the related information about himself and/or the house if there is foreigner from other provinces within the inhabitant, to assist and supervise Party B to handle the Temporary Residential Permit at Local Police Statio

11、n. And Party B should go to Local police station to handle the Lodging Registration within 24 hours if there is any person from other countries, from the time when this contract has been set up.If the rental purpose is not residence, from the date when this contract has been set up, within 30 days,

12、Party A should go to the department of Local House Administration to handle the Lease Contract Registration filing procedure.第三条 租赁期限 Article 3:Lease Term(一)房屋租赁期自年月日至年月日,共计年个月。甲方应于年月日前将房屋按约定条件交付给乙方。房屋交割清单(见附件一)经甲乙双方交验签字盖章并移交房门钥匙与后视为交付完成。(a) From the date/to/totallymonths. Party A should vacate the

After Party A and Party B had signed and sealed the“Property list” (appendix 1), and Party A had delivered the key of the house and to Party B, the house have been delivered.(二)租赁期满或合同解除后,甲方有权收回房屋,乙方应按照原状返还房屋与其附属物品、设备设施。甲乙双方应对房屋和

14、附属物品、设备设施与水电使用等情况进行验收,结清各自应当承担的费用。乙方继续承租的,应提前 30 日向甲方提出(书面 / 口头)续租要求,协商一致后双方重新签订房屋租赁合同。(b) Party A has the right to retract the house upon the expiration of the leasehold or the dissolution of the contract, and, Party B should return the leased house and accessary facilities in original state to Par

15、ty A. Both parties must check and accept the house and the accessory facilities, meanwhile, settle accounts of the cost which should be bore by their own.If the Lessee intends to renew the leasehold, should notify (written/oral) the Lessor within one month before termination. Both parties should con

18、mends for any loss of unusual damage.第五条 其他相关费用的承担方式 Article 5: Other fees租赁期的下列费用中,由甲方承担,由乙方承担:(1)水费(2)电费(3)费(4)电视收视费(5)供暖费(6)燃气费(7)物业管理费(8)房屋租赁税费(9)卫生费(10)上网费(11)车位费(12)室设施维修费(13)费用。During the lease term, Party B should bear fees thatParty A should bear fees that(a) Water fee(b) Electrical bill(c)

19、 Telephone bill(d) TV expense of television reception(e) Heating expense(f) gas expense(g) Property management fee(h) Housing rental taxes(i) Health costs(j) Internet expense(k) Parking fees(l) Indoor facilities maintenance costs(m)others本合同中未列明的与房屋有关的其他费用均由甲方承担。如乙方垫付了应由甲方支付的费用,甲方应根据乙方出示的相关缴费凭据向乙方返还

20、相应费用。The Party A should bear other fees which this contract has not listed which concern the house. If the Party B had paid the fees related proof, Party A should returned corresponding fees to Party B.第六条居间服务 Article 6: Intermediary services(一)丙方应当认真负责地为甲乙双方订立房屋租赁合同提供机会或媒介服务,如实报告有关订立房屋租赁合同的事项,并协助甲乙

21、双方办理物业交验。(a) Party C should provide the opportunity or the medium service to both parties conscientiously and earnestly, and notice the information of this contract to both parties faithfully, and assist them to check and accept the property.(二)本合同签订后(即时/ 日),甲方应向丙方支付月租金的%即人民币元整(:)作为佣金,支付方式:现金/转帐支票/银

22、行汇款;乙方应向丙方支付月租金的%即人民币元整(:)作为佣金,支付方式:现金/转帐支票/银行汇款。甲乙双方支付的佣金总合应不超过月租金标准。(b) Upon the contract have been signed (Immediate/withindays), Party A should pay% of the monthly rental to Party C as service fee. The total of remuneration should not surpass the monthly rental.(三)本合同签订后,如租赁双方解除、中止或变更租赁关系的,租赁双方仍应向丙方支付所约定的佣金。(c) Once the contract has been signed, the remuneration couldnt be returned whether this contract is

24、 rescinded or suspended, or modified.第七条 房屋维护与维修 Article 7: Maintenance and repair(一)甲方应保证房屋的建筑结构和设备设施符合建筑、消防、治安、卫生等方面的安全条件,不得危与人身安全;承租人保证遵守国家、市的法律法规规定以与房屋所在小区的物业管理规约。(a) Party A should ensure that the construction and facilities of rental house is conformed to relevant laws and regulations. Party B

25、 could not do any unlawful or illegal activities which are not allowed according to the State laws, the government regulations and the local byelaw. In the period of rents, both parties should keep the house, the facilities and goods attached to the house in safe and suitable.(二)租赁期,甲乙双方应共同保障房屋与其附属物

26、品、设备设施处于适用和安全的状态:(b)In the period of rents, both parties should keep the house, the good and facilities attached to the house in applicable and safe:1、对于房屋与其附属物品、设备设施因自然属性或合理使用而导致的损耗,乙方应与时通知甲方修复。甲方应在接到乙方通知后的 7 日进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。因维修房屋影响乙方使用的,应相应减少租金或延长租赁期限。aParty B should notice Party A ab

27、out any damage of the houses due to poor quality, natural tear and wear or calamities. Party A should be responsible for repairing in 7 days and bear the expenses. Provided Party A has not repaired on schedule, Party B could repair instead of Part A. Party A should bear the expenses which should be

28、undertaken by himself. Once the repairing has made an impact on the usual life, Party A should reduce rental or extend the period of rent correspondingly.2、因乙方保管不当或不合理使用,致使房屋与其附属物品、设备设施发生损坏或故障的,乙方应负责维修或承担赔偿责任。bThe damage of the premises or the fittings that is within the control of the party B shoul

29、d be borne by party B.第八条 转租 Article 8: Transfer or Sublet除甲乙双方另有约定以外,乙方需事先征得甲方书面同意,方可在租赁期将房屋部分或全部转租给他人,并就受转租人的行为向甲方承担责任。Party B should not partly or totally sublet without the written permission from party A. If the house has been transferred or sublet, Party B should be liable for compensating for

30、 any behavior of sublet person.第九条 合同解除 Article 9: Dissolution of Contract(一)经甲乙双方协商一致,可以解除本合同。(a) The contract can be rescind based on the agreement(二)因不可抗力导致本合同无法继续履行的,本合同自行解除。(b) If Force Majeure cause to terminating the contract, the contract is rescinded.(三)甲方有下列情形之一的,乙方有权单方解除合同:(c) If Party A

31、has one of the following behaviors, Party B has the right to rescind this Contract unilaterally.1、迟延交付房屋达 7 日的。a Within 7 days, Party A has not turn over the house.2、交付的房屋严重不符合合同约定或影响乙方安全、健康的。b The house does not conform to the contract seriously or affects the safety and healthy of Party B.3、不承担约定的

32、维修义务,致使乙方无常使用房屋的。c Because Party A has not repaired house, Party B could not use house normally.4、。d (四)乙方有下列情形之一的,甲方有权单方解除合同,收回房屋:(d) If Party B has one of the following behaviors, Party A has the right to rescind the Contract unilaterally and take back the house.1、不按照约定支付租金达日的。a If Party B delays

33、rental payment in the excess of _days.2、欠缴各项费用达元的。b If Party B delays kinds of fees in the excess of _yuan.3、擅自改变房屋用途的。c If Party B changes the use of the leased house unilaterally.4、擅自拆改变动或损坏房屋主体结构的。d If Party B changes or damages the main structure of house unilaterally.5、保管不当或不合理使用导致附属物品、设备设施损坏并拒

34、不赔偿的。e The damage of the premises or the fittings that is within the control of party B and party B refuses to compensate.6、利用房屋从事活动、损害公共利益或者妨碍他人正常工作、生活的。f The Party Bs behaviors in the house are unlawful or interfere with other peoples life.7、擅自将房屋转租给第三人的。g The Party B transfer or sublet the leased

35、 house unilaterally.8、。 h (五)其他法定的合同解除情形。(e) Other legal situations of contract rescission.第十条 违约责任 Article10: Responsibility for breach of the Contract(一)甲方有第九条第三款约定的情形之一的,应按月租金的200%向乙方支付违约金;乙方有第八条第四款约定的情形之一的,应按月租金的200%向甲方支付违约金,甲方并可要求乙方将房屋恢复原状或赔偿相应损失。(a) Either of Parties behaviors results in the t

36、ermination of the contract before its expiration, the penalty for breach should be 200% of monthly rental . Party A has the right to take back the premises and take actions against party Bs breach.(二)租赁期,甲方需提前收回房屋的,或乙方需提前退租的,应提前 30 日通知对方,并按月租金的 200 %向对方支付违约金;甲方还应退还相应的租金。(b) In the period of rent, ei

37、ther Party A shall take back the house ahead, or Party B shall return the house before the contract expiration, he should informed the other party ahead of 30 days. Tort-feasor agrees that the penalty for breach of contract shall be 200% of monthly rental. At the same time, Party A should return the

38、 surplus rent.(三)因甲方未按约定履行维修义务造成乙方人身、财产损失的,甲方应承担赔偿责任。(c) Party A has not repaired the house in time according to the contract, so Party Bs security has been damaged. Party A should undertake the liability of compensation.(四)甲方未按约定时间交付房屋或者乙方不按约定支付租金但未达到解除合同条件的,以与乙方未按约定时间返还房屋的,应按 日租金的200% 标准支付违约金。(d)

39、Having not rescinded the Contract, but tort-feasor agree that the penalty for breach of Contract shall be 200% of daily rental surpasses one day.a Party A shall not turn over the houses on schedule to Party B for use.b Party B shall not pay the rental on schedule according to the provisions of the C

40、ontract.c Party B shall not return the house on schedule according to the provisions of the Contract.(五)丙方提供虚假信息、隐瞒重要事实或有恶意串通行为的,除退还已收取的佣金外,还应赔偿由此给甲方或乙方造成的损失。(e) Having behaviors in the following, besides returning the service fees received, the party C should also compensate the loss of Party A or

41、Party B.a Party C provided the false information to two parties.b Party C concealed important fact to two parties.c Party C colluded with the third party maliciously.(六)。(f) 第十一条 合同争议的解决办法 Article 11: Handling of disputes本合同项下发生的争议,由双方当事人协商解决;协商不成的,依法向有管辖权的人民法院起诉,或按照另行达成的仲裁条款或仲裁协议申请仲裁。(a) Any disput

42、e arising from the execution of, or in connection with, the contract shall be settled through friendly negotiation between tripartite parties. In case no settlement can be reached, the disputes shall be submitted to the peoples court, which has jurisdiction over the houses. Or compelled arbitration

43、in accordance with the arbitration clause or the arbitration agreement.(b) This contract will be governed by and construed under the laws of the Peoples Republic of China.第十二条 其他约定事项 Article 12: Other matters。本合同经三方签字盖章后生效。本合同(与附件)一式份,其中甲方执份,乙方执份,丙方执份,执份。This contract will be effective after being s

44、igned by tripartite parties. There are 3 originals of this contract. Every party will hold 1 original(s). If translation or understanding lead to discrepancy in this bilingual contract, the Chinese version will be the standard.本合同生效后,双方对合同容的变更或补充应采取书面形式,作为本合同的附件。附件与本合同具有同等的法律效力。If tripartite parties

45、 have any specific matters, the supplementary written agreement may agree it upon. The appendix is the integral part of this contract. The appendix and this contract are equally valid.
