Thestatementintheemployeescurriculumvitae,resume,referencesandotherinformationsubmittedtotheemployerinsupportoftheEmployeesapplicat
3、ionforthispart-timepositionmustbetrueandnotmisleadinginanysense.4. Theemployeehasavalidpassport.TheemployeeisnotamemberofanyorganizationthatmayberegardedbyauthoritiesasathreattopublicsecurityorsocialorderofChina.5. Theemployeemustperformthedutiesinaprofessionalanddiligentmanner.6. Theemployeemustobe
4、ythewrittenand/orverbaldirectionsoftheemployer.7. Theemployeemustatalltimecomplywiththetermsandconditionsofthisjobofferandagreementandtherulesandregulationsoftheemployer.8. TheemployeemustatalltimecomplywiththelawsofthePRC9. TheemployeemustnotharmtheimageoftheEmployerorotherstaffwiththeemployer.10.
5、TheemployeemustprovidethepassportandvisacopytoHRdepartmentwithinoneweekaftertheagreementissigned.RemunerationTheEmployeesremunerationiscalculatedaccordingtohis/heractualteachinghours:1. Theactualteacherhourshouldbenotmorethan4hoursperdayandnotmorethan24hoursperweek.2. RMB150perclass(beforetax).Usual
6、lytheschoolwillarrangetwoclassesinarowandanotheryuanwillbegivenasatransportationfeeeverytimetheESLteachercomestoteach.3. Theschoolshouldnotetheemployeeone-weeksworkingscheduleifthereisanychangeupontheagreedschedule.4. Thefirstperformancereviewwillbemadeafterthefirstmonth.Andthereviewreportwillbearef
7、erenceforraisingthesalaryoftheparttimeteachers.5. Theemployeewillbepaidonthe10thofeachmonth,notinadvance,fortheteachinghoursinthepreviousmonth(every1sttothelastdayofthemonth).6. TheEmployeegetsthepaymentinthecenterwithinthepayperiodfromthe10thtothe15thofeverymonth.Overtheperiod,theemployeeshouldcont
8、actthedirectEducationSupervisorforthepayment.PenaltyforMisconduct1.Thepenaltytakesformofterminationofthisagreementordeductioninpayforthemonthwhenthemisconductoccurs.Misconductsincludefailureinteachingscheduledclasseswithoutanoticeatleastonedayinadvance,beinglateforthescheduledclassesformorethan8minu
9、tes,andotherconductsthatmaynegativelyinfluencetheemployer.2.Iftheemployeefailsinteachingscheduledclasseswithoutanoticeatleastonedayinadvance,thedeductioninpayisRMB200perincident.Anyothermisconduct,thedeductioninpayisRMB300perincident.Andtheemployeemustnotetheschoolatleast7sevendaysearlierifheorsheis
10、goingtoendthiscontractbeforethevalidityperiodofthiscontract,oranotherRMB300isgoingtobededucted.3.Exceptionsareaccidentsorurgenthealthproblems,inwhichcase,theemployeemustinformtheEducationSupervisorassoonashe/sherealizestheaccidentorproblemandmustfindorrecommendasubstituteteacherwiththequalifications
11、requiredbytheemployer.TerminationTheemployerreservestherighttoterminatethisagreementinthefollowingcircumstances:1. Theemployeebringstheschoolintodisrepute.2. Misconductsoftheemployeeoccur.3. Theemployeebreachestheconfidentialityclauseasreferredtoinsection“confidentiality”4.Iftheemployeeisguiltyofder
12、elictionofduty,incompetence,insubordination,dishonestyorotherbreachesofemployeesdutiesorobligationsunderthisagreementortherulesandregulationsoftheschool.5.Theemployeefailstoworkfor30consecutivedays.Theemployeereservestherighttoterminatethisagreementwithatwo-weeknoticeinwritinginthefollowingcircumsta
13、nces:TheemployerfailstocomplywiththetermsofthisagreementConfidentialityTheemployeemustkeepallinformationregardingtotheemployersteachingmethodsandadministrationconfidential.Theemployeemustnotdisclosedetailsofhis/heragreement.Theemployeemustnotusetheemployersteachingmethodsandmaterialsforanyotherpurpo
14、se.Theobligationsoftheemployeeconcerningthesectiontitled“Confidentiality”willsurvivetheterminationofthisagreement.GeneralTheemployercannotarrangetheemployeethenewworkingschedulewithoutemployeesagreementandshouldconfirmwithemployeeeveryFridayforthenextweeksscheduleonEmailorMessage.Andtheemployeeshoul
15、dsticktothescheduleonceconfirmwiththeschoolonEmailorMessage.Theemployerreservestherighttoaddextraclassesinshortnoticeupontheemployeesagreement.ThisagreementwillbeinterpretedinaccordancewithandissubjecttothelawsofPRC.ThepartiessubmitirrevocablytothejurisdictionofthecourtsofthePRCinrespectofanydisputerelatingtoorconcerningthisagreement.ThetermsandconditionsofthisagreementprevailoveranyconflictingorinconsistentprovisionsoftheEmployersrulesorregulations.Thisagreementiseffectiveimmediatelyandsupersedes第6页共7页
